1. Acceptance
These Terms of Service govern your access to and use of dangerreport.com and its content (the "Site"), operated by T3 Sixty LLC ("T3 Sixty", "we", "us"). By using the Site you agree to these terms. If you do not agree, please do not use the Site.
2. What this site is
The Site is an online archive of The D.A.N.G.E.R. Report — a Definitive Analysis of Negative Game changers Emerging in Real estate, researched and authored by Stefan Swanepoel and first published on 14 May 2015. It is provided free of charge as an industry reference.
3. The report is historical and forward-looking
This is important. The report was published in 2015 and describes hypothetical future events that may or may not occur. It has not been updated since publication. The dangers it identifies are a compilation of opinions gathered from industry leaders at that time; they are not predictions, findings of fact, or statements about any organisation's current condition. Scores, timings and probabilities reflect assessments made in 2014–2015 and should be read in that context.
4. Not professional advice
Nothing on the Site is legal, financial, investment, tax or other professional advice, and it must not be relied on as such. Information may or may not apply to your market. You are urged to use sound judgment and consult proper counsel and experts before making any significant decision.
5. No warranty
The Site and its content are provided "as is" and "as available". To the fullest extent permitted by law, we make no representations or warranties as to the accuracy or completeness of the contents, and specifically disclaim any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose. To the fullest extent permitted by law, T3 Sixty, its affiliates, and the report's authors, editors and publishers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of your access to or use of the Site or reliance on its content. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
7. Acceptable use
You agree not to:
- use the Site in violation of any applicable law;
- attempt to gain unauthorised access to the Site or any related system;
- interfere with or disrupt the Site, including by automated means that place an unreasonable load on it;
- scrape or bulk-copy the Site's content for republication in a way that competes with or substitutes for it; or
- remove, obscure or alter any copyright, trademark or other proprietary notice.
Ordinary reading, citation, linking and search-engine indexing are welcome.
8. Intellectual property
Rights in the report and in this Site are described in theEnd User Licence Agreement, which governs what you may do with the report and the material on this Site.
9. Trademarks
REALTOR® and the REALTOR® marks are registered trademarks of the National Association of REALTORS®. Other names and marks referenced on the Site are the property of their respective owners. Their use here is for identification and commentary and does not imply endorsement.
10. Third-party links and embeds
The Site links to and embeds third-party material, including YouTube videos. We do not control and are not responsible for third-party content, and a link is not an endorsement.
11. Availability and changes
We may modify, suspend or discontinue the Site or any part of it at any time without notice. We may also revise these terms; the "last updated" date above will change and the revised terms take effect when posted.
12. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. The exclusive venue for any dispute arising out of these terms or the Site is the state or federal courts located in Orange County, California, and you consent to their jurisdiction. Nothing here deprives a consumer of the protection of mandatory laws of their country of residence.
13. Severability
If any provision of these terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions remain in full force.
